GREENSBORO A former Davie County sheriff’s deputy was sentenced today to 18 months in federal prison on drug charges.

Bobby Lee Mabe Jr. pleaded guilty Sept. 7, 2010, in U.S. District Court in Greensboro to being an unlawful user of controlled substances while possessing firearms and with maintaining a drug-involved premises. Federal prosecutors said Mabe was having an affair with the sheriff’s office’s evidence technician who would steal the drugs and give them to Mabe.

The criminal investigation against Mabe started when his wife suspected he was having an affair, according to court documents. She searched his patrol car, looking for evidence that he was seeing someone else, and found bags of marijuana that had been stolen from the sheriff’s evidence room.

Malinda York, the former evidence technician, pleaded guilty May 13, 2010 to conspiracy to distribute 5 grams or more of crack cocaine and to possessing a firearm in the furtherance of a drug-trafficking crime. She is scheduled to be sentenced April 29.

Both resigned from the sheriff’s office in 2009.

Judge William Osteen Jr. also sentenced Mabe to three years of supervised release. Mabe will have to perform 15 hours of community service each month of his first year of supervised release. He also will have to pay $200 in court costs.
