Bicyclist dies after being hit

A man who was hit by a car while riding his bicycle Wednesday has died.

Scott Alan Bailey, 31, of Tobaccoville, a second-year law student at Wake Forest University, died from his injuries Thursday morning, according to a spokeswoman for the N.C. Highway Patrol.

The highway patrol said that Bailey was riding his bicycle north on Doral Drive in Tobaccoville about 12:30 p.m. Wednesday when he was hit by a car driven by August "A.J." Spieler III, 39, of Bethania.

The incident happened where the road curves near Stewart Park Road.

Bailey was wearing a helmet and was riding on the far right of the two-lane road, by the white line. Spieler was also heading north and hit Bailey from behind, said the spokeswoman, who summarized Trooper Barry Hiatt's notes on the wreck.

Spieler stopped after the wreck.

The highway patrol said that charges were pending but did not specify the charges.

Spieler was driving at 40 mph. The speed limit on Doral is 45 mph. There is no indication that alcohol was involved, the highway patrol said.

Spieler's attorney, Chris Clifton, said he also did not know what the charges would be. Clifton declined to comment about what happened.

"Mr. Spieler is devastated by what happened," Clifton said. "It was truly an accident, and all of his thoughts right now are focused on the victim and his family."

A phone message left with Spieler's family was not returned yesterday.

Jennifer Collins, an associate professor at Wake Forest's law school, said that Bailey was a student whose enthusiasm made him stand out.

He had been a musician and music teacher for about 10 years before going to law school. He had a wife and child, Collins said.

"He was just an unbelievably good-natured person who loved the chance to be in law school, loved the life and was just thrilled to be here," she said. "It's a devastating loss."

The wreck has at least one witness, a man on a horse who was heading south, said Joyce Payne, who lives on Doral Drive, across the street from where Bailey was hit.

Payne, who did not see the wreck, said the man on the horse told her that he saw Spieler strike Bailey, throwing Bailey off the bike.

This is the second collision involving bicyclists this week.

On Monday night, a Surry County ambulance hit Daquanta Mack, 15, and Jamaal Shell, 16, as the two were crossing the 5200 block of University Parkway.

Winston-Salem police said that Mack and Shell rode into the ambulance's path. No charges were filed.

Mack remained in critical condition at Wake Forest University Baptist Medical Center last night. Shell was in good condition.
