Three sheriff's deputies were involved in a three-hour standoff that ended in gunman's death

LEXINGTON - The State Bureau of Investigation is reviewing the actions of three Davidson County sheriff's deputies after a three-hour standoff Wednesday that left four injured and one man dead.
The deputies -- Lt. Marvin K. Potter, Lt. Edwin Thomas Curry and Deputy James Felton Hull Jr. -- were involved in the fatal shooting of Aubrey Roy Roseberry, 58, after Roseberry held several people hostage at gunpoint at a house on Shuford Everhart Road, east of Lexington.
Such reviews by the SBI are standard practice in shootings involving law-enforcement officers.
The Davidson County Sheriff's Office would not confirm the names of the gunman or victims because the SBI is investigating the incident. The SBI confirmed that Roseberry was the gunman.
Family members and neighbors said that the injured included Tabitha Spivey, her 13-year-old son and 17-year-old daughter, and the daughter's 20-year-old boyfriend, Daniel Spainhour.
Spainhour was listed in good condition yesterday at Wake Forest University Baptist Medical Center in Winston-Salem. The conditions of the other three were not immediately available yesterday.
The shootings stemmed from a dispute earlier in the day.
Sheriff David Grice said that Roseberry was the complainant when deputies were first called to the neighborhood about 3 p.m. Wednesday.
Roseberry complained that the Spiveys were painting their barn with a sprayer and that paint damaged his cars, Grice said.
Grice said he didn't know who called 911 about the incident, but said that a deputy spent about an hour Wednesday afternoon taking a report of property damage and what happened from all parties involved.
"He was very agitated," Grice said of Roseberry.
Daniel Spainhour's mother, Charlton, said that her son told her that after deputies left, Roseberry taunted him and his girlfriend at the property line.
Roseberry had a gun and asked them if they were afraid, she said. She said that deputies returned to the neighborhood later in the afternoon.
Noelle Talley, a spokeswoman for the SBI, said that the investigation is continuing.
Once the investigation is complete, the SBI will deliver its findings to Garry Frank, Davidson County's district attorney, Talley said.
