Batman star Christian Bale will not face charges relating to an allegation of assault last month on his mother and sister, prosecutors said yesterday, suggesting that their decision was based in part on the family members' wishes. Britain's Crown Prosecution Service said that there was insufficient evidence to afford a "realistic prospect of conviction," and ordered police not to take any further action. The service said in a statement that although it "treats all incidents which take place in a domestic context seriously, it is important that the views of complainants are also taken into account when making decisions in such cases." Bale, who denies the allegation, said through his spokeswoman, Jennifer Allen, he was relieved that the issue had been settled. Bale "hopes to put the matter firmly behind him" and will be providing no further comment, Allen said in a statement released by Bale's attorneys. His family had previously declined to comment, saying it was a personal matter.

■ Kid Rock is returning to the Video Music Awards on Sept. 7 for another hit performance -- and this time it does not involve a fistfight with Tommy Lee. Rock is scheduled to perform "All Summer Long" from his platinum-selling CD Rock ‘N Roll Jesus. Last year, he was not a performer, but he was involved in one of the ceremony's most talked about moments when he scuffled with Lee while they were sitting in the audience. Both were at one time married to Pamela Anderson, who was also in attendance. The fight was not shown on camera, but provided fodder for jokes from the likes of Diddy and Jamie Foxx.

■ Tom Cruise is in negotiations to play the title character in Spyglass Entertainment's remake of the French spy thriller The Tourist. He has been considering the project for weeks as one of several potential next moves, and it is likely to be the next project he tackles. Bharat Nalluri will direct screenwriter Julian Fellowes' adaptation of the 2005 movie, which follows an American tourist used as a pawn in a spy game by a female Interpol agent. Cruise's career has been in a slump in recent months after delays of the release of his Nazi-fighting biopic Valykrie. He was recently replaced by Angelina Jolie in the reconfigured drama Edwin A. Salt.

■ Sid Ganis was elected to a fourth consecutive one-year term as president of the Academy of Motion Picture Arts and Sciences, the academy said Wednesday. Ganis, 68, who has served as academy president since 2005, calls the job "a privilege." "It's a dynamic time for our organization and our art form," he said. He has produced films such as Akeelah and the Bee, Big Daddy and Deuce Bigalow: Male Gigolo. He has also worked for Sony Pictures, Paramount Pictures and Lucasfilm. Ganis has been a member of the film academy since 1968.
