California appellate court backs award in smoker case

A California appeals court has upheld a jury's awards from 2007 involving Altria Group Inc.'s Philip Morris USA and Reynolds American Inc., the Tobacco Products Liability Project said yesterday.

The jury found the cigarette-makers liable in the death of a 40-year-old smoker, Leslie Whiteley, and awarded $2.4 million to her family.

The awards were $2.3 million on wrongful-death claims, $250,000 in punitive damages against Reynolds on the false-promise cause of action, and $225,000 for past economic damages. The jury also awarded Leonard Whiteley, Leslie's widower, $30,000 for pre-death loss of consortium.
